An Independent Grievance Mechanism Can’t Wait / Un Mecanismo de Reclamación Independiente no puede esperar (ECO 9, SB56)

Dear Article 6 negotiators, ECO knows you did a lot of work over the last several years and that you have a long work plan this year. So, we don’t want to add too much to your plate. However, we would be remiss if we didn’t point out the importance of establishing the independent grievance mechanism.

ECO celebrated in Glasgow when the final decision at COP26 included the establishment of an independent grievance process.  Having an avenue for communities to seek remedy when they’re harmed is essential for respecting the rights of local communities and Indigenous Peoples. But that’s not where the work ends. Now, Parties must establish this process, and it can’t wait. The independent grievance mechanism should be set up before any Article 6 activities take place.

Structures and procedures should be put in place to ensure the independent grievance mechanism is legitimate, accessible, equitable, predictable, transparent, rights-based, and a source of learning. The past has shown us that carbon market activities can and do negatively impact people and their environment. Respecting the right to access effective remedies requires that communities have a place to go when this happens. And that really means when it happens or when they think it will happen, and not years in the future.

Also, don’t limit it to activities under the 6.4 mechanism. To be an ITMO, the cooperative approach must respect human rights including the rights of Indigenous Peoples, and so if someone is negatively impacted by such an activity, they should have access to the grievance mechanism. The right to access effective remedy is a human right.

So, as you work to make Article 6 operational, one of the first things you must do is establish an effective independent grievance mechanism.

Un Mecanismo de Reclamación Independiente no puede esperar

Estimados negociadores del artículo 6, ECO sabe que han trabajado mucho en los últimos años y que tienen un largo plan de trabajo este año. Por lo tanto, no queremos añadir demasiado a su plato. Sin embargo, seríamos negligentes si no señaláramos la importancia de establecer el mecanismo independiente de reclamación. 

ECO celebró en Glasgow que la decisión final de la COP26 incluyera el establecimiento de un proceso de reclamación independiente.  Disponer de una vía para que las comunidades busquen remedio cuando se ven perjudicadas es esencial para respetar los derechos de las comunidades locales y los pueblos indígenas. Pero ahí no acaba el trabajo. Ahora, las Partes deben establecer este proceso, y no puede esperar. El mecanismo independiente de reclamación debe establecerse antes de que se lleve a cabo cualquier actividad en virtud del artículo 6. 

Deben establecerse estructuras y procedimientos para garantizar que el mecanismo independiente de reclamación sea legítimo, accesible, equitativo, predecible, transparente, basado en los derechos y una fuente de aprendizaje. El pasado nos ha demostrado que las actividades del mercado de carbono pueden tener, y tienen, un impacto negativo sobre las personas y su entorno. Respetar el derecho a acceder a remedios efectivos requiere que las comunidades tengan un lugar al que acudir cuando esto ocurra. Y eso quiere decir realmente cuando ocurra o cuando crean que va a ocurrir, y no años en el futuro. 

Además, no hay que limitarse a las actividades del mecanismo 6.4. Para ser una ITMO, el enfoque cooperativo debe respetar los derechos humanos, incluidos los derechos de los Pueblos Indígenas, por lo que si alguien se ve afectado negativamente por dicha actividad, debe tener acceso al mecanismo de reclamación. El derecho a acceder a un recurso efectivo es un derecho humano. 

Por lo tanto, a medida que se trabaja para que el artículo 6 sea operativo, una de las primeras cosas que hay que hacer es establecer un mecanismo de reclamación eficaz e independiente.
