The International Indigenous Peoples Forum on Climate Change is back in Bonn for in-person climate action call! We all witnessed the regression of climate actions during the Covid pandemic and the increase of inequality in and exclusion from decision making on climate change. Our priority is still an urgent call for sufficient reduction of GHG emissions in order to meet the Paris Agreement\u2019s goal of no more than 1.5 degrees Celsius of global warming.\u00a0<\/p>\n\n\n\n


Climate action taken by States must not violate our collective rights. All climate actions must fully comply with the UN Declaration on the Rights of Indigenous Peoples, particularly, our rights to Self-Determination and Free, Prior and Informed Consent.<\/p>\n\n\n\n


Our Indigenous knowledge, our rights, and our governance are recognized by the IPCC as crucial to address climate change. They recognize that colonialism continues to do us harm. Colonialism appears in the Paris Agreement itself, with its constant reference to \u201cbest available science\u201d rather than \u201cbest available knowledge.\u201d Indigenous knowledge must play its rightful role in addressing the climate crisis. Our contributions to climate action far exceed the emissions directly attributed to our communities. Indigenous Peoples call for a new paradigm \u2013 sustainability. 70% of the people of the world are fed by small Indigenous and local producers. They are sustainable.<\/p>\n\n\n\n


We call for a process for non-state actors, including Indigenous peoples, to define climate finance. indigenous peoples must have direct access to climate finance to implement climate solutions according to our priorities and self-determination.<\/p>\n\n\n\n


Indigenous Peoples have an important role to play and serve to maintain the balance between nature and the needs of all life. We welcome support for the Local Community and Indigenous Peoples Platform. We hope and expect that it may help to lead us to a sustainable world.<\/p>\n\n\n\n


In connection with Article 6, Indigenous peoples ask parties to ensure compliance with the rights of Indigenous Peoples by taking the following considerations into account:<\/p>\n\n\n\n


On Article 6.4, in its Annex under Section B (Governance and Functions) paragraph 24(a) provides that the\u00a0\u201cSupervisory Body shall, in accordance with the relevant positions of the CMA (a) Establish the requirements and processes necessary to operate the mechanism, relating to, inter alia; (\u2026) (ix) (\u2026.) the rights of Indigenous Peoples (\u2026).\u201d<\/em>2. This means that the rights of Indigenous Peoples inform the interpretation of all provisions under Article 6.4, and the Supervisory Body must establish requirements and processes to ensure the implementation of those rights. Paragraph 31(d)(iv) provides that the Supervisory Body shall also minimize and, where possible, avoid negative environmental and social impacts.\u00a0
Therefore, in interpreting when consultation is appropriate or applicable under article 31(e) or the content of such consultation, recourse must be given to the UN Declaration on the Rights of Indigenous Peoples, specifically Article 19 which requires consultation whenever an undertaking may affect Indigenous Peoples.\u00a0<\/p>\n\n\n\n


In addition, it informs the nature of the consultation which must be conducted in good faith in order to obtain the Indigenous Peoples\u2019 free, prior and informed consent.<\/p>\n\n\n\n


3. Also the independent grievance process outlined in paragraph 62 must provide for the full, and effective participation of Indigenous Peoples and comply with due process.<\/p>\n\n\n\n


It is the first week of the negotiations, by the end of the second week Parties should make substantial progress on these issues. We can\u2019t go back home and report back to our communities that our rights are in brackets.\u00a0<\/p>\n\n\n\n

ECO se complace en compartir esta parte de nuestra publicaci\u00f3n con el Caucus de los Pueblos Ind\u00edgenas (IPO) para ayudar a amplificar su voz. Este art\u00edculo refleja las opiniones del IPO.<\/em><\/p>\n\n\n\n

El Foro Internacional de los Pueblos Ind\u00edgenas sobre el Cambio Clim\u00e1tico vuelve a Bonn para convocar una acci\u00f3n clim\u00e1tica presencial. Todos hemos sido testigos del retroceso de las acciones clim\u00e1ticas durante la pandemia de Covid y del aumento de la desigualdad y la exclusi\u00f3n de la toma de decisiones sobre el cambio clim\u00e1tico. Nuestra prioridad sigue siendo el llamamiento urgente a una reducci\u00f3n suficiente de las emisiones de gases de efecto invernadero para cumplir el objetivo del Acuerdo de Par\u00eds de no superar los 1,5 grados cent\u00edgrados de calentamiento global.<\/p>\n\n\n\n

Las acciones clim\u00e1ticas adoptadas por los Estados no deben violar nuestros derechos colectivos. Todas las acciones clim\u00e1ticas deben cumplir plenamente con la Declaraci\u00f3n de las Naciones Unidas sobre los Derechos de los Pueblos Ind\u00edgenas, en particular, nuestros derechos a la libre determinaci\u00f3n y al consentimiento libre, previo e informado.<\/p>\n\n\n\n

El IPCC reconoce que nuestros conocimientos ind\u00edgenas, nuestros derechos y nuestra gobernanza son cruciales para abordar el cambio clim\u00e1tico. Reconocen que el colonialismo sigue haci\u00e9ndonos da\u00f1o. El colonialismo aparece en el propio Acuerdo de Par\u00eds, con su constante referencia a la “mejor ciencia disponible” en lugar del “mejor conocimiento disponible”. El conocimiento ind\u00edgena debe desempe\u00f1ar el papel que le corresponde a la hora de abordar la crisis clim\u00e1tica. Nuestras contribuciones a la acci\u00f3n clim\u00e1tica superan con creces las emisiones atribuidas directamente a nuestras comunidades. Los pueblos ind\u00edgenas piden un nuevo paradigma: la sostenibilidad. El 70% de la poblaci\u00f3n mundial se alimenta de peque\u00f1os productores ind\u00edgenas y locales. Son sostenibles.<\/p>\n\n\n\n

Pedimos un proceso para los actores no estatales, incluidos los pueblos ind\u00edgenas, en la definici\u00f3n de la financiaci\u00f3n clim\u00e1tica. Los pueblos ind\u00edgenas deben tener acceso directo a la financiaci\u00f3n clim\u00e1tica para implementar soluciones clim\u00e1ticas de acuerdo con nuestras prioridades y autodeterminaci\u00f3n.<\/p>\n\n\n\n

Los pueblos ind\u00edgenas tienen un importante papel que desempe\u00f1ar y sirven para mantener el equilibrio entre la naturaleza y las necesidades de toda la vida. Acogemos con satisfacci\u00f3n el apoyo a la Plataforma de Comunidades Locales y Pueblos Ind\u00edgenas. Esperamos y deseamos que pueda ayudar a conducirnos hacia un mundo sostenible.<\/p>\n\n\n\n

En relaci\u00f3n con el art\u00edculo 6, los pueblos ind\u00edgenas piden a las partes que garanticen el cumplimiento de sus derechos teniendo en cuenta la siguiente consideraci\u00f3n:<\/p>\n\n\n\n

1. Sobre el Art\u00edculo 6.4, en su Anexo bajo la Secci\u00f3n B (Gobernanza y Funciones) el p\u00e1rrafo 24(a) establece que el “\u00d3rgano de Vigilancia deber\u00e1, de acuerdo con las posiciones pertinentes del AMC (a) Establecer los requisitos y procesos necesarios para operar el mecanismo, en relaci\u00f3n con, entre otras cosas; (…) (ix) (….) los derechos de los Pueblos Ind\u00edgenas (…)”<\/em>.<\/p>\n\n\n\n

2. Esto significa que los derechos de los Pueblos Ind\u00edgenas informan la interpretaci\u00f3n de todas las disposiciones bajo el art\u00edculo 6.4, y el \u00d3rgano de Vigilancia debe establecer los requisitos y procesos para asegurar la aplicaci\u00f3n de esos derechos. El p\u00e1rrafo 31(d)(iv) establece que el \u00d3rgano de Supervisi\u00f3n tambi\u00e9n deber\u00e1 minimizar y, cuando sea posible, evitar los impactos ambientales y sociales negativos.<\/p>\n\n\n\n

Por lo tanto, a la hora de interpretar cu\u00e1ndo es apropiada o aplicable la consulta en virtud del art\u00edculo 31(e) o el contenido de dicha consulta, se debe recurrir a la Declaraci\u00f3n de las Naciones Unidas sobre los Derechos de los Pueblos Ind\u00edgenas, concretamente al art\u00edculo 19, que exige la consulta siempre que una empresa pueda afectar a los pueblos ind\u00edgenas.<\/p>\n\n\n\n

Adem\u00e1s, informa de la naturaleza de la consulta, que debe realizarse de buena fe para obtener el consentimiento libre, previo e informado de los Pueblos Ind\u00edgenas.<\/p>\n\n\n\n

3. Asimismo, el proceso de reclamaci\u00f3n independiente descrito en el p\u00e1rrafo 62 debe prever la participaci\u00f3n plena y efectiva de los Pueblos Ind\u00edgenas y cumplir con el debido proceso.<\/p>\n\n\n\n

Es la primera semana de las negociaciones, al final de la segunda semana las partes deben hacer un progreso sustancial en estos temas.
